In May 2026 the U.S. District Court for the Middle District of Florida issued a preliminary injunction in favor of Zest Brands LLC (Case No. 8:26-cv-483-MSS-CPT) staying and FDA's Refuse-to-File (RTF) determination in respect of the ZEO Universe nicotine pouch products.

A Note on the PMTA Process
The FDA's Premarket Tobacco Product Application process requires manufacturers to demonstrate that their product is appropriate for the protection of public health. It is a rigorous, science-based review that takes time. Many brands operating in the nicotine pouch category are at various stages of this process.
